A bench of acting Chief Justice Gita Mittal and Justice C Hari Shankar earlier this week demanded an explanation from all authorities concerned on why they have not yet taken any strict action to curb the malaise. The observation and directive came during the hearing of a PIL alleging rampant corruption in the offices where properties are registered. "Is it not a way of life here," the bench asked when the issue of illegal registration of commercial properties as residential ones was raised before it in the [URL="https://timesofindia.indiatimes.com/topic/plea"]plea[/URL] by a lawyer, who also sought a CBI or SIT probe into the matter. The court then proceeded to issue notices to the Delhi government, including its revenue, service and vigilance departments, the anti-corruption branch (ACB), CBI and the controller of accounts, seeking their stand on the allegations made in the petition. The bench also directed the office of the lieutenant governor to file a separate status report on the registration of transactions in relation to transfer of immovable properties taking place in the jurisdiction of the sub-registrar's office mentioned in the petition and listed the matter for hearing on March 7. The petitioner referred to a specific sub-registrar office in [URL="https://timesofindia.indiatimes.com/topic/Old-Delhi"]Old Delhi[/URL] and alleged that the official there was accepting [URL="https://timesofindia.indiatimes.com/topic/bribes"]bribes[/URL] to register commercial properties as residential ones, leading to a "huge loss of revenue" to the state exchequer. He also alleged that such practices were probably prevalent in all sub-registrar offices in Delhi, given the brazen manner in which the official he met was demanding and receiving bribes for this work. The petitioner claimed that despite several representations and complaints made against the alleged illegal activity, no action was taken, forcing him to approach the court. Urging the court to intervene, the petitioner sought strict actions against the official concerned and directions to CBI to investigate the large-scale corruption so that common people don't suffer. According to an FIR filed by the [URL="https://timesofindia.indiatimes.com/topic/CBI"]CBI[/URL], Inderjeet, a [URL="https://timesofindia.indiatimes.com/topic/patwari"]patwari[/URL], facilitated tampering of records pertaining to around 25 bighas of land in connivance with one Mahesh. Apart from this 25 bighas, the CBI is probing transfer of around 97 bighas of prime government land in Asola to private persons. The total 122 bighas would be worth Rs 600 crore at current market prices. A part of these transfers were linked to Inderjeet though all the changes took place during his tenure. In one of the FIRs registered to probe transfer of 25 bighas to Mahesh, the CBI claimed the "khasra girdawari" inspection report by revenue officers to verify land ownership and use and other reports were prepared in favour of Mahesh, who later sold 10 bighas out of it to one Raman Mehra. An enquiry showed that tampering in the [URL="https://timesofindia.indiatimes.com/topic/land-records"]land records[/URL] pertaining to gram sabha land in Asola was done after January 30, 2014 and before to April 24, 2015. After altering the records, a no-objection certificate was issued by Inderjeet and sale deed registered. Subsequently, mutation was done in favour of Mehra who made the purchase from Mahesh. The process allowed Mehra to become a bhumidaar (land owner) in place of the gram sabha without due process as per Delhi land revenue rules, 1962. In its enquiry report, the additional district magistrate (east) said, "It seems true that the said tampering was done during the tenure of Inderjeet patwari and hence he may be held responsible for the conspiracy behind the said tampering." The CBI FIR suggested that Inderjeet tried to blame his assistants claiming that NoC and other reports were prepared by them even though he admitted they were not authorised to make a report or entries. A Bench headed by judicial member S. P. Wangdi said: "First status report of the work should be filed by February 26 and the final demarcation report shall be submitted on March 13. Since enough time has been taken by the Revenue Department and other authorities concerned to complete the work, further time sought to complete the work is granted with strict direction that the work shall be completed within the next one month." [B]Rs. 2 lakh fine[/B] The green panel stated that in case of non-compliance with the order, strict action will be taken against the officers concerned. "In the event of failure to comply with this direction, cost of Rs. 2 lakh shall be paid by each of the respondents, particularly the Revenue Department and the Forest Department of the Delhi government. Disciplinary proceedings shall also be directed against the personnel concerned," the Bench noted. Rapping the Delhi government for the pending demarcation, the Bench stated; "Order dated December 20, 2017, is clear and categorical in directing that the regime prescribed for the process of demarcation was required to be strictly followed in order to avoid floodgate of claims and counter claims by all concerned parties having land adjoining the Ridge or forest land in villages of Ranpuri, Rajkori and Ghitorni in Vasant Kunj sub-division." [B]Slams casual approach[/B] The green panel came down heavily on the government, terming the approach by the authorities as "casual". "Upon perusal of the records of the case, we find that there has been absolute casualness on the part of the authorities concerned and have been recalcitrant and, as observed earlier, procrastinating in completing the work entrusted upon them," the Bench noted. The directions came while the green tribunal was hearing a plea by south Delhi resident Sonya Ghosh and others, who had alleged that there were encroachments on the forest land area in the Southern Ridge. The petitioners had sought for removal of the encroachments.
