NOIDA/GHAZIABAD: The [URL="https://timesofindia.indiatimes.com/topic/Allahabad-high-court"]Allahabad high court[/URL] has ordered shifting of all [URL="https://timesofindia.indiatimes.com/topic/religious-structures"]religious structures[/URL] that were constructed on public land after January 1, 2011, and encroach on roads, pathways, lanes and side roads. The high court also directed the chief secretary to file a compliance report after three months. On [URL="https://timesofindia.indiatimes.com/topic/encroachments"]encroachments[/URL] that took place before January 2011, the court has directed that they be shifted from their present place within six months. A division bench of [URL="https://timesofindia.indiatimes.com/topic/Justices-Sudhir-Agarwal-and-Ajit-Kumar"]Justices Sudhir Agarwal and Ajit Kumar[/URL] on Friday also made the DM, district police chiefs and circle officers of police accountable for the encroachments made on road after June 10, 2016. The district administrations of Noida and Ghaziabad said on Saturday they would comply with the order once they got a copy of it. According to officials, a list of such religious places has already been submitted to the high court in 2011 and a committee comprising the district magistrate and the SSP will start implementing the order after a review of the law and order situation. According to the ADM of Gautam Budh Nagar, Kumar Vineet, no encroachments took place in the district after 2011. In Noida alone, four-five religious places are encroaching public land, including one in the green belt, abutting the main service road of [URL="https://timesofindia.indiatimes.com/topic/Noida-Greater-Noida-Expressway"]Noida-Greater Noida Expressway[/URL] in Sector 127. The Shani Mandir in Sector 127 came up in the green belt after an existing temple built in 1972 was extended by Swami Jaswant Nathji who was gifted a piece of 10 square feet by a Bakhtawarpur resident. Mahant Shiv Nath Baba, who currently administers the temple, told TOI that his predecessor Swami Jaswant Nathji fought a court case in 2005 to get a stay order for vacation of the green belt area for creation of the service road. A curved road has been built abutting the temple. �In 2016, the villagers attacked me with an intention to take ownership of the land so that they could take compensation claim on the green belt. I had to leave the temple for some time due to injuries. We wrote to chief minister Yogi Aditya Nath who directed the authorities to reinstate us at the temple,� he said. The Atta Peer � a religious memorial built in June 1986 by Hukum Singh in memory of his son Rambal Singh � has not been shifted despite takeover of private land by Noida Authority. While the memorial stands on the green belt located on the main road between Sector 17 and 18 abutting the busy Captain Vijayant Thapar Marg, devotees line up outside the same especially on Thursdays. Similarly, the Hanuman temple is located on the main road in Hajipur of Sector 104 and a major part of it is on the main road connecting the sector with the expressway. Pandit Ramesh Pathak, who looks after its affairs, said it is almost 25-years-old. In neighbouring Ghaziabad, the district administration had conducted an anti-encroachment drive on the green belt along Sucheta Kriplani Marg in Shakti Khand 4 in January last month following a TOI report, but demolished only the illegal banquet halls on the stretch leaving behind religious sites comprising a temple, a gurdwara and a church. In an RTI reply, the GDA had made it clear that it has not allotted land to any religious sites on the green belt. The encroachments on Shakti Khand�s green belt had come up only in the past five years. Such structures are also encroaching green belts in Seva Nagar, Meerut Road, Kavi Nagar and Bulandshahr industrial area. Officials in the NMRC said the two governments had recently signed a memorandum of understanding on the project. �The Centre will now release Rs 970 crore as part of its share in the 50-50 joint venture,� said PD Upadhyay, the executive director of NMRC who also holds the post of GM (finance). The officials said that with the Centre coming into play, the project would be expedited. Now that the project is a joint venture, the Union urban development secretary will propose a new chairman of the Noida Metro Rail Corporation to replace the current one, UP chief secretary Rajive Kumar. Officials said the NMRC board would be reconstituted with both the central and the state governments nominating four directors each. The NMRC board will have a full-time managing director nominated by the state government. Apart from the board members, functional directors, who are usually experts in their fields, will also be appointed. In May last year, finance minister Arun Jaitley had given the formal approval for the Centre�s share of funds. �Though there was never a funds crunch, the pact with the Centre would certainly help in expediting clearances and making payments for project,� said Upadhyay. �We have received a letter on this dated February 19 from the ministry of housing and urban development,� he added. Upadhyay further said the NMRC would function as a Special Purpose Vehicle for the implementation of the project while legal cover for the corridor would be provided under the Metro Railways and Railways Act. The NMRC board on Friday reviewed the progress of the metro corridor, which is currently undergoing trials. �Electrical, mechanical and signalling work is about 80% complete,� said Upadhyay. The buildings, which are in varied stages of construction have been declared unauthorized by the Authority and after giving due notices have been sealed. These buildings also face demolition, Authority officials told TOI. According to Authority officials, the buildings were being constructed on Noida�s notified land. �No one other than Noida Authority can give permission for the construction on this land and no permission has been granted by us to the buildings being built on Khasra numbers 319,329,328,362,357,361,359 and 365 measuring almost 5 acres of land,� said Rajesh Singh, Officer on Special Duty (OSD), Noida Authority. �As per our Master Plan 2031, the land measuring 20,000 sqm has been earmarked for residential use. Authority had earmarked the said land for distribution to farmers as 5% developed plots in lieu of acquiring their lands,� he explained. �The sealing drive was carried out amidst heavy police presence. More than 150 personnel participated in the drive,� he added. Singh further said that Authority had pasted warning notices to stop all construction in the area as it was unauthorised and illegal, but the unauthorized builders have not paid any heed. �Hence on Friday we have sealed 11 buildings so far,� he said. �This drive will carry on till all encroachment is removed from Noida�s notified land,� he said. �We will also not shy away from carrying out demolition of these illegal buildings,� he added. [h=2]On January 3 last month also Noida Authority had sealed 16 unauthorized buildings in village Garhi Chokhandi in the city. Located along the Faridabad-Noida-Ghaziabad (FNG) e-way, the unauthorized construction had been carried out across nearly 7 acres of land worth more than Rs 200 crore by illegal colonisers. �We have not yet demolished these buildings as some colonizers have gone to court, while others are in process of making representations against the sealing. Further action will be taken after due diligence to ensure no injustice is carried out,� he promised.[/h] Following the incident and toughening his stand against land sharks duping innocent people, Chairperson and CEO of Noida Authority Alok Tandon has further directed officials to work in co-ordination with the GB Nagar police and district administration against all illegal use of Noida�s notified land. The CCEO has also issued strict instructions to not �spare unauthorized colonizers who are busy taking unsuspecting people for a ride�.
