A bench of Justices Madan B Lokur and Deepak Gupta said the Centre's focus over the years had been to protect businessmen, who are [URL="https://timesofindia.indiatimes.com/topic/illegally"]illegally[/URL] operating their businesses from residential premises, and neglecting the needs and requirements of other residents of the city. It asked the government why interests of traders, who comprise only around 10-15% of Delhi's population, are given priority over the interests of the common man. The court is examining the validity of Delhi Laws (Special Provisions) Act, passed in 2006 to give a protective cover for one year to illegal constructions and use of residential premises for commercial purposes in the city after the apex court had ordered sealing drive against them. Although the law was framed to give protection for only one year, the Centre passed successive Acts and ordinances to extend the deadline and the last law was passed by Parliament in December to protect illegal constructions till 2020. Additional solicitor general A N S Nadkarni, appearing for Centre, said the government would file a road map for dealing with the problems. He said the law was framed to give protection to unauthorised constructions to avoid hardship and irreparable loss to a large number of poor people and it was not only to give protection to traders. The bench said it is aware of the plight of poor people living in unauthorised colonies but asked the Centre why it was allowing traders to operate their businesses from such colonies. "Sum and substance of your arguments is that the government was not doing anything and it will not do anything till 2020. So we should adjourn the case till then," it said referring to the law passed in December. "You have to realise that people of Delhi are important but you are amending the Master Plan to allow unauthorised structures. Illegalities have been perpetuated over the years and they are being legalised now. There are large number of problems like garbage, huge traffic congestion, water shortage, air pollution but your are protecting the illegalities of traders," the bench said. Nadkarni assured the court that he would file a detailed plan of action including new parking policy on Wednesday. [h=2]Referring to the Government of National Capital Territory of Delhi Act, senior advocates Ranjit Kumar and A D N Rao, who are assisting the court as amicus curiae, said the Centre was to set up satellite towns in NCR as per the law to shift unauthorised colonies from Delhi but the Government is not taking any step to comply with it.[/h] Justifying the protection given to unauthorised structures, the Centre said, "A substantial portion of the city's population lives in slums/unauthorised colonies, therefore the government, being duty-bound to protect the poor, had to intervene on humanitarian grounds even as such inhabitants are encroaching on public or private land. It may be submitted that it was an emergent circumstance whereby people cannot be left to their fate as the unauthorised development that has happened was demand-based and failure of the agencies to keep up with the growing demand. [b]CAG Lists Lack Of Co-Ordination, Carelessness Key Reasons Behind Delhi's Sorry State[/b] The Comptroller and Auditor General's (CAG) report card of Delhi that was tabled by Deputy Chief Minister Manish Sisodia on April 3 in the state Assembly is not a positive note. The revenue receipt of the Aam Aadmi Party-led government fell by Rs 653.11 crore in financial year 2016-17 as compared to the previous financial year due to decrease in non-tax revenue and a shortfall of Rs 1,433.13 crore in grants from the Centre. That is only the start. In the words of Sisodia, the CAG has identified several "rigidities" in the system, the key highlight of the report. [b]Roads stuck due to lack of coordination among agencies [/b] From 77.85 lakh in 2012-13 to 1.03 crore in 2016-17, the number of vehicles plying on Delhi roads has increased substantially. However, municipal bodies in the national capital did not build any new road projects during that period despite all the hullaballoo around "decongesting Delhi". The CAG reports noted lack of coordination among multiple agencies responsible for planning and developing roads in the national capital is the key reason behind that. There is also no effective mechanism for citizens to report their grievances regarding specific roads to the agencies concerned, the CAG says. "Multiple agencies were responsible for Delhi road network. The urban development department did not establish any mechanism to coordinate the efforts of these agencies to prepare a perspective plan, lack of which hindered the effective planning and coordination in developing Delhi road network in a phased manner to cope up with ever increasing population of vehicles in the city," it stated. This lack of coordination has also resulted in cost overruns. According to the CAG report, the estimated cost of the Rani Jhansi Flyover, which is expected to ease traffic along the Inter-State Bus Terminus, has increased from over Rs 177 crore to over Rs 724 crore. [b]Sewer work delayed by 10 years[/b] While Rs 10.85 crore has been spent by the Delhi Jal Board on laying sewer pipes, there has been a delay of 10 years in completing the task. Lack of due diligence and non-adherence of timelines by the DJB led to inordinate delay in laying sewer pipes, says the report. The sewer laying work was to be completed by September 2007; It was still "work in progress" as of June 2017. [b]Not one toilet built in Delhi under the Swachh Bharat Mission[/b] The Swachh Bharat Mission was launched in the national capital with a great deal of fanfare in October 2014. The money the national capital received to make itself open-defecation free, however, is lying idle. According to the CAG, not one toilet was constructed has been built in Delhi since the inception of till March 2017 the much-talked mission while it received Rs 40.31 crore under the mission. The beneficiaries of unauthorised colonies were also not considered for construction of household toilets under the mission, says the report. "Most of the habitats known for lack of toilet facilities were excluded from the mission at the planning stage itself," it points out. [b]While cutting generously, Delhi is not planning enough trees[/b] Between April 2014 and March 2017, over 13,000 trees – 13, 018, to be specific – were cut in the national capital for various purposes. This made it obligatory on the state forest depart to plant 65,095 trees in compensation—According to Section 10 of the Delhi Preservation of Trees Act, for felling of one tree, five saplings must be planted. Only 33 per cent of this target has been met, and the shortfall stands at 67 per cent, says the CAG report. All the noise going around the city trying to become green in the wake of rising pollution levels is also falling on deaf ears. The report points out that the national capital does not have its own forest policy, a road map or a perspective plan indicating strategy to improve forest cover. "The tree authority constituted under the Delhi Preservation of Trees Act, 1994, met only once during 2014-17 against mandated 12 meetings. In violation of permit conditions, lops and tops arising out of pruning/felling of trees were not supplied free of cost to the public crematoria," the report said. [b]Inadequate planning by tourism dept causing major losses[/b] The CAG has come down heavily on the Delhi Tourism and Transportation Development Corporation (DTTDC) for "lack of inadequate diligence and planning", while citing specific cases. According to the CAG report, the construction work at Mayur Vihar's Dilli Haat incurred "infructuous" expenditure to the tune of Rs 39.66 lakh owing to lack of planning. "Without waiting for permission for change of land use, the DTTDC appointed three consultants for structural design, proof checking of structural design and architectural consultancy in June, August and September 2013, respectively," the report said. The DTTDC should not have financially committed itself by appointing the consultants without prior permission from the DDA, it said. According to the CAG, inadequate due diligence and planning on the part of DTTDC resulted in avoidable delay of 12 years in developing 5.22 acres of land at Saidu-ul-Ajab village for stated use and wasteful expenditure of Rs 23.19 lakh.

[h=1]Rs 10.9 crore spent by DJB with nothing to show[/h] TNN | Updated: Apr 4, 2018, 02:59 IST NEW DELHI: Citing the case of sewerage work in east Delhi's Shahdara that has been going on for a decade after its deadline of 2007, CAG rapped Delhi Jal board for "ad-hoc planning, lack of due diligence and failure to respect timelines". The central auditor's reports pointed that despite spending Rs 10.9 [URL="https://timesofindia.indiatimes.com/topic/crore"]crore[/URL], the main objectives of stopping sewage overflow near VM College and surcharge the existing sewers in the catchment area to stop polluting the Yamuna had not been met. Recalling the tangled path that the east Delhi project has taken, the report said [URL="https://timesofindia.indiatimes.com/topic/DJB"]DJB[/URL] cancelled the contract in August 2009 after completion of 25% of the project for which Rs 1 crore had been paid to the contractor. "DJB re-awarded the balance work to a new contractor at cost of Rs 4.8 crore with some amount to be recovered from first contractor. The second contractor too could not complete the work, and DJB short-closed the contract by paying Rs 2.9 crore. An amount of Rs 6.88 crore was also paid as road restoration charges to the road-owning agencies. Even the completed portion hasn't been put to use since 2011," the report noted. In its response to the CAG's red flag, DJB said first contract was cancelled due to non-performance, while it short-closed the second contract because the required 16-feet-deep excavation work could not be carried out due to heavy traffic on the road crossing, underground utilities and the subsoil condition. CAG said DJB's response was non-tenable and non-acceptable because the water board should have known about these impediments. "Besides, DJB hasn't done any analysis as to how much of completed work could be used when sewer-laying work on gaps at four crossings is completed in 2018," report added. CAG also criticised DJB for the lack of synchronisation in procurement of equipment worth Rs 3.18 crore for renovation of the filtration system in the Chandrawal water treatment plant which led to equipment lying unused for over six years. "Though the civil construction work of the filter house was taken up, the contractor procured the equipment between 2009 and 2011. Foreclosure of the work rendered equipment unusable and the same is idling since purchase," CAG said. The audit report also raised doubts about the utility of this equipment since it had remained unused for such a long period of time. CAG has also raised questions about the way the 25 MGD sewage treatment plant in Yamuna Vihar was constructed. A Bench of Justices Madan B. Lokur and Deepak Gupta wanted to know from the Centre if they had any plan to deal with the issue which has arisen in Delhi on which the traders were staging protest against the ongoing sealing drive. "Do you have any plan or you just want these traders to hold the city on ransom. Do you have any plan," the Bench asked Additional Solicitor General (ASG) A.N.S. Nadkarni, appearing for the Centre. Responding to the query, Mr. Nadkarni said, "The Government of India does not feel that way. We just want to have a solution for it". When the Bench asked whether the government has thought of any solution, the ASG said, "the Master Plan of Delhi-2021 is a solution of all this". The court then asked "what about unauthorised colonies? You have changed the Master Plan to legalise what is illegal." [B]Proposes road map[/B] The ASG said the Master Plan of Delhi-2021 has not yet been finalised and he could place a road map before the court about what the government proposes to do in the matter. The Delhi Development Authority had proposed amendments in the Master Plan of Delhi-2021, including bringing uniform floor area ratio (FAR) for shop-cum-residence plots and complexes at par with residential plots, a move that would come as a big relief to traders facing the threat of sealing. FAR is the ratio of a building's total floor area (gross floor area) to the size of the piece of land upon which it is built. On March 6, the SC had stayed any further progress by the authorities to amend the Master Plan of Delhi-2021. "What about past illegalities? You are saying that you will protect it [unauthorised constructions] till 2020," the Bench asked, adding, "will these illegalities continue till 2020?". The ASG said he would come up with a road map on the issue and the court posted the matter for hearing tomorrow.
