A bench of Justices [URL="https://timesofindia.indiatimes.com/topic/Madan-B-Lokur"]Madan B Lokur[/URL] and Deepak Gupta said people cannot be allowed to continue building homes in violation of the law and government authorities could not be mute spectators by permitting violation of building laws and by-rules. Senior advocate Ranjit Kumar and lawyer A D N Rao, who are assisting the court as amici curiae, told the bench that poor people are building homes in unauthorised colonies under the impression that these will be allowed once their colonies are regularised and pleaded for a stay on construction activities. The bench then ordered a freeze on construction in unauthorised colonies. Agreeing with their submission, the bench said, �In view of this, we direct there should not be any construction in unauthorised colonies and on public land.� It noted that the apex court had, way back in 2004, passed orders not to allow construction in unauthorised colonies but this was not enforced by civic agencies in the intervening 14 years, resulting in mushrooming of illegal construction. The court also made it clear that even after it approved the government�s decision to regularise these colonies, structures which were constructed in violation of building rules and bylaws would not be protected. The Centre and the [URL="https://timesofindia.indiatimes.com/topic/Delhi-Development-Authority"]Delhi Development Authority[/URL] agreed with the bench and said such structures would be demolished. Additional solicitor general Maninder Singh, appearing for the DDA, told the bench that there was no question of providing amnesty to illegal construction even if colonies were regularised. People will have to comply with building bylaws. �Regularisation will be only for the approved building and the rest will go. Regularisation is only for colonies and not to protect illegal construction. The people living there would have to take approval for their building from the authorities,� he said. In other words, if a building where two floors were approved and additional ones have come up, the one in violation of laws will need to go. The court also turned down the Centre�s plea to vacate its stay on amendments to the city�s Master Plan 2021, and asked it to �first prove its bona fide� by taking action in compliance of its order and posted the case after two weeks. The court directed the Centre to immediately constitute a task force as proposed by it earlier and begin removing encroachment on roads, pavements and streets within two weeks. [h=2]The Centre had informed the bench that DDA has decided to constitute a 13-member special task force headed by its vice-chairman to identify encroachment of government land and move to reclaim it. Puri said that the project at Kathputli Colony will be not only a slum re-development project but also rekindle hope and trust between the state and similarly placed citizens in other slums. He further said that this redevelopment project, which was conceived way back in the year 2009, is finally seeing the light of the day and will provide clean, well planned and habitable units together with adequate social infrastructure to the people of Kathputli colony. Kathputli redevelopment project is one of the first re-development projects under the Public Private Partnership (PPP) mode. The developer will meet his cost through building and disposing of freehold flats and commercial built up area equivalent to 10% of EWS FAR on lease hold basis. These unauthorised colonies, mostly housing low-income families, have stories of how politics and policy have given the residents a dream of a �legal home� for decades, but have not fulfilled it. Tuesday�s [URL="https://realty.economictimes.indiatimes.com/tag/supreme+court"]Supreme Court[/URL] directions on stopping all illegal constructions again remind that the assurance of regularisation of such colonies is far from reliable. At the present, the cut-off date for regularisation of constructions in these colonies stands at January 1, 2015, as revised by the Union urban development ministry. However, Delhi government�s urban development department is awaiting detailed maps with demarcations of boundaries to be able to respond to the queries raised by the Centre after the change in the cut-off date. The answers to the queries depend on the information on these maps. The state�s revenue department was tasked with carrying out the ground surveys and it started the time consuming work in 2015 with the total station method survey. The department needs to authenticate the maps from 2007 submitted to the state government by residents� welfare associations in 2008 by comparing the information there to the one they collect in the surveys. Sources said the survey and mapping on ground is almost finished in around 930 of the 1,797 colonies, but the district level survey is posing challenges. The ground realities have changed much since RWAs submitted the maps in 2008 when it was stipulated that unauthorised colonies would be eligible for regularisation if they had a coverage of 50% or more in 2007. Inability of the authorities to stop fresh constructions over the years has meant that many colonies have expanded beyond the original boundaries. Also the revenue department officials point out that a mapping exercise would also require looking into the land status of that area based on revenue records. The1,797 colonies on the list of regularisation were identified in a process started during the Congress regime in 2008 when the Centre promoted guidelines to step up regularisation. The years that followed saw the issue getting embroiled in politics and red tape and the regularisation dream remaining unfulfilled. The Aam Aadmi Party came to power in 2015 promising regularisation of colonies, and has since taken up the issue from time to time, expediting demarcation of boundaries and getting municipal corporations to make layout plans. Eventually one saw the government only highlighting development works in these colonies because regularisation did not appear to be round the corner.
