A bench of acting Chief Justice Gita Mittal and Justice C Hari Shankar referred to a 2012 HC verdict to note that the Ministry of Urban Development (MoUD) had listed RSC as one of the statutory bodies which organised special functions on October 2 and January 30 to observe the birth and death anniversaries of Mahatma Gandhi. It directed the committee to ensure maintenance of the memorial in order to show reverence to the Father of the Nation. HC was unhappy after going through the report prepared by local commissioner, advocate Satyakam, revealed the "deplorable" state of Rajghat. The lawyer was tasked by the court to inspect the site and file a report which said even the water bodies inside area are full of dirt. "The sapling planted by the VVIPs and dignitaries including head of states and national and international leaders are also not maintained. There are filthy toilets and unhygienic canteen and no taps for water. Even the samadhi is not maintained," it said, adding that there is no proper facility for disabled people who visit the memorial. The bench also commented that despite the drawbacks, the committee had argued vociferously that everything was in place and they were maintaining the area regularly. It ordered that the RSC should immediately stop any "knee jerk repairs" from being undertaken in view of this court's reaction. The bench also sought the presence of Nipun Malhotra, a disability rights activist on whose petition it has seperately ordered a disability audit of government buildings in the capital. HC's directions came while hearing a public interest litigation (PIL) which alleged that Mahatma Gandhi's memorial was not being properly maintained. Petitioner Shyam Narayan Chouksey had claimed that the memorial "was not at all being properly and cleanly maintained", and despite being brought to the notice of the committee and MoUD, there has been no change in the situation. In the PIL, Chouksey has submitted photos of alleged deficiencies that he had come across during his visit to the monument in 2014 and then again in 2015 and 2016, when he claimed the situation had worsened. He has alleged there were betel stains at the entrance, broken floor tiles, rubbish lying all around the monument, the white marble has turned black due to lack of cleaning while the green carpet laid for visitors to walk was damaged. The Greater Kailash metro [URL="https://timesofindia.indiatimes.com/topic/station"]station[/URL] on Outer Ring Road — which is part of the 38.22-km long Botanical Garden-to-Janakpuri West Magenta Line — is being given the finishing touches. While the first 12.64-km long section of this line between Botanical Garden and Kalkaji Mandir was opened in December last year, the next 25.58-km long section between Kalkaji Mandir and Janakpuri West is likely to be opened by March-end or early April. At present, the Nehru Place and Govindpuri metro stations on the Violet Line (Kashmere Gate-Escorts Mujesar) are the only ones close to this part of south Delhi. With the opening of the [URL="https://timesofindia.indiatimes.com/topic/GK"]GK[/URL] station, not only will metro come to the doorsteps of the residents but also give them direct connectivity with Noida on one side and west Delhi on the other. And with the upcoming Hauz Khas interchange station on the Magenta Line just two stations away, they will be able to easily switch to the Yellow Line (Samaypur Badli-HUDA City Centre), shortening the journey towards Gurugram and central and north Delhi. The road near DT Cinemas (earlier Savitri Cinema), which leads to Greater Kailash I, Chittaranjan Park, Alaknanda and many other colonies, besides many schools, is already a traffic bottleneck. With the opening of the entry and exit points of the station here, it is likely that it will get further choked by e-rickshaws, autorickshaws and cycle rickshaws that will appear for providing last-mile connectivity. This will prove to be a big challenge for the traffic police. Multi-modal integration, however, is not an issue on the other side where the underground station is located. "A long slip road has been created for autorickshaws along the perimeter of the station, which will function as a drop off zone. We have also created bus bays near the station, where buses can enter from the main road, pick and drop passengers and move out to the main road," he said. The surface of the underground station has been designed as a plaza with ample greenery and sitting area for commuters. Creating the subway from the station was a big challenge for DMRC as many utilities had to be shifted. "There were high-tension power lines, gas lines, telephone lines and stormwater drains, which had to be moved to create the subway through 'box pushing' technique as construction couldn't be done on the busy road," said the official. At the end of the road is a water-filled pit surrounded by garbage, rocks, a broken boundary wall and monkeys chattering in the trees. This portion comprises Khasra No 1354 in the land revenue records of Asola [URL="https://timesofindia.indiatimes.com/topic/village"]village[/URL] in [URL="https://timesofindia.indiatimes.com/topic/south-Delhi"]south Delhi[/URL]. This expanse actually belongs to the village, and is, therefore, government land, but has allegedly been sold to a woman buyer, Raman Mehra, by a private dealer who had conned her into the transaction by promising her a better tract across the road. This illegal sale of government land obviously could not have been accomplished without the connivance of the lower revenue officials who hold the key to land status, the patwari, kanungo and tehsildar. This case and five other land deals in this village are under the scanner of the Central Bureau of Investigation. As reported by TOI earlier, according to one FIR, Inderjeet, a patwari, facilitated the tampering of records of 25 bighas of gram sabha land in connivance with one Mahesh. [URL="https://timesofindia.indiatimes.com/topic/CBI"]CBI[/URL] is probing the transfer of another 97 bighas of government land in [URL="https://timesofindia.indiatimes.com/topic/Asola"]Asola[/URL] to private persons. The 122 bighas would cumulatively be worth around Rs 600 crore at current market prices. The FIR on the transfer of 25 bighas to Mahesh claims that the "khasra girdawari" inspection report, used by revenue officers to verify land ownership, land use and other property details, was prepared in favour of Mahesh, who then sold 10 bighas to Mehra. A probe established that the records related to these bighas were tampered with after January 30, 2014 and before April 24, 2015. The murky trail showed that after altering the records, a no-objection certificate was issued by Inderjeet and the sale deed registered. The mutation was subsequently done in favour of Mehra. The process allowed Mehra to become a bhumidaar (land owner) in place of the gram sabha without due process as required under Delhi Land Revenue Rules, 1962. Since the fraud was unearthed, the district authorities have rectified the false changes in the records and restored land status to "gram sabha land". The process to secure the same expanse on the ground has also been started. But that is where the challenge begins. Mehra's plot, Khasra No 1354, is a case in point. While on paper it is back with the gram sabha, the block development officer is yet to secure it. Also, a nearby farmhouse forms a portion of this khasra and the dividing road too is a part. This raises a question mark on how sales were executed in the past and whether a similar modus operandi was employed then. Adding to the complex land issue are the acres of land here fenced off as forest land. The landscape of less than 500 metres, therefore, shows a mix of farmhouses, roads, forest land and gram sabha land. Evidently, the land mafia is thriving on the gaps in the revenue record system and the land laws of Delhi. While the government has been striving to digitise land records, these cases of fraud focus attention on the robust khasra girdawari, a document in which the patwari enters details like the name of the plot's owner and cultivator, land/khasra number, area, kind of land, category of cultivated or non-cultivated land, source of irrigation, name of crop and other facts. This is updated every year. It was this updating of details that exposed the fraud regarding Khasra No 1354 in 2015. Sources said that a scrutiny of the records revealed how the gram sabha land ownership record was changed in the khatauni through a nexus of patwari, kanungo and tehsildar. Other similar cases emerged, and today Delhi government is handling the iceberg of illegal sale of gram sabha land. In Asola, with the chakbandi maps made by the British in 1908 not available, the historical evolution and demarcation of khasras cannot be determined, making the role of the khatauni, khasra girdawari and the patwari even more critical. Also, an active network of blackmailers thrives in the area with thousands of crores of rupees at stake for those who have bought land there or have their possession under scrutiny. The district magistrate of South district has started getting every single land record verified with the gram sabha records. There is a plan to upload the data on the status of every khasra in the 14-odd villages of South district for public scrutiny with the aim of unearthing any discrepancy. A bench of Justices Madan B Lokur and Deepak Gupta, which has recently revived sealing drive against unauthorised constructions in Delhi, said the case would be heard from April 2 on a day-to-day basis. The apex court had in April 2013 asked the Delhi high court to adjudicate validity of the law but the case remained pending in the HC for five years and the [URL="https://timesofindia.indiatimes.com/topic/SC"]SC[/URL] on December 15 last year transferred the case to itself to take a final call on its validity. The bench is also examining the validity of Delhi Development Authority's (DDA) decision to amend the master plan to bring relief to traders who are facing the heat of the ongoing sealing drive. The move seems to be heading towards a roadblock with the court seeking an explanation from it along with the Delhi government and the municipal corporations on whether proper research or study was done by them on the impact of the amendment on environment and existing infrastructure of the city. The sealing drive of unauthorised constructions in Delhi was revived in the city in January after the SC allowed court-appointed monitoring committee to identify and seal illegal premises as the government authorities had failed to check building of such illegal structures. The apex court had in March 2006 ordered sealing of all unauthorised constructions in the city and appointed a monitoring committee. The sealing drive went on till January 2012 when the court asked the committee not to proceed further. But the committee was asked to keep filing reports on the status of unauthorised constructions in the city. "The project is right now in approval process. We will build and sell the entire project in phases. The first lot of apartments to be sold in this project will come out in the next 3-4 years," said a senior finance executive at DLF. Marking a major shift in its business strategy, the company has recently taken a decision to sell only ready-to-move-in apartments from now on. "The company will focus on selling the completed inventory valued at about ₹15,000 crores (net of pending construction payments) on its books over the next 3-4 years," DLF said in its investors' presentation released following the announcement of its earnings for the quarter ended December. Promoters of DLF have sold their 33.34% stake in its rental arm DLF Cyber City Developers Ltd ([URL="https://realty.economictimes.indiatimes.com/tag/dccdl"]DCCDL[/URL]) to GIC for ₹8,956 crore. Both Delhi and central governments should wake up from slumber and understand the implications of sealing and its impact on economy and trade in the city, the traders said. Meanwhile, north corporation sealed 49 units against misuse of property and unauthorised construction on Thursday. "The building department carried out sealing in five zones and 49 units were sealed for flouting the norms. Sealing is for the municipal agencies to look into". Senior advocate Ranjit Kumar, assisting the court as an amicus curiae in the matter, said the issue was of 2006 and it was strange that after 12 years, the Centre wants to file an affidavit. To this, the Bench observed, "According to Union of India, the Supreme Court is responsible for the delay". The Bench, while asking the Centre to file a reply in three weeks, posted the matter for hearing on April 2. "The ASG says that he will collect the papers from the amicus and file an affidavit justifying the Delhi Laws (Special Provisions) Act, 2006 within a period of three weeks from today. We make it clear that no further time will be granted," the Bench noted in its order. "For a proper management of the cases, we make it clear that we do not propose to hear any counsel on behalf of the petitioners. If there are any submissions that they wish to make, they may do so through the amicus. We will, of course, hear the Union of India, the DDA (Delhi Development Authority), the Delhi Government and the corporations," the Bench said. [B]Issue of validity[/B] The Bench would deal with the issue of validity of the Delhi Laws (Special Provisions) Act, 2006 and subsequent legislations. The apex court had earlier said that the authorities do not appear to have carried out their statutory duties in preventing illegal construction in Delhi. It had in December last year observed that rule of law over sanction to construct buildings has "completely broken down" in Delhi while expressing concern over rampant illegal construction. The apex court had also ordered restoration of its 2006 monitoring committee to identify and seal such offending structures. The monitoring committee, comprising K.J. Rao, former advisor to the Election Commissioner, Bhure Lal, Chairman, Environment Pollution (Prevention and Control Authority) Authority (EPCA) and Major General (retd) Som Jhingan, was set up in March 24, 2006, by the apex court. The court had earlier said it had asked the committee not to seal any premises from 2012, expecting the authorities to carry out their statutory duties. The government has decided to come up with a multi-department action plan in this year's budget, which is being projected as Delhi's first 'green budget' by the city administration. The government is also mulling over conducting a realtime source apportionment study (to find if machines can be employed to detect sources of pollution at any given time and help the government take measures accordingly) in collaboration with the University of Washington. These proposed measures will be finalised by February 22. Deputy Chief Minister Manish Sisodia today held a review meeting on the preparedness for the 'green budget' with senior officials of environment, transport, forest and power departments. According to government sources, Sisodia asked departments concerned to finalise their proposals along with budgetary requirements and submit them formally to the planning or finance department by February 22 after approval of their ministers. The official said the environment department has proposed fast-tracking of adoption of clean tandoors while the transport department advocated engagement of electric buses, promotion of smaller electric vehicles and strengthening of PUC system. "The power department has also proposed special policy mechanism/incentives to promote adoption of solar energy in PWD departments, schools and hospitals," the official said. Officials said that through the action plan, the Delhi government intends to make a "good impact" towards pollution control over the next two years as it feels air pollution in the city has reached crisis level.
